GENERAL CONDITIONS FOR THE SALE OF ADVERTISING SPACE

Article 1: Object

The terms and conditions of sale described below detail the rights and obligations of EuropeSoftwares with respect to its advertising management service.

Any performance performed by EuropeSoftwares  on behalf of a client therefore implies that the customer has been made aware of these terms and conditions of sale and that he fully adheres to these same conditions. The customer thus renounces any application of his possible terms and conditions of purchase.

The prestation consists of the rental of advertising space.  EuropeSoftwares  is doing everything possible to increase the number of displays in its advertising spaces, but is unable to guarantee minimum quotas in terms of the number of postersperweek. You have an interface to see the performance of your advertising space.

Article 2: Price

Any service ordered by a customer to EuropeSoftwares  is due by that same customer, including in case of cancellation by the linkbefore the service isperformed.

Article 3: Payment terms

Benefits are settled before any benefit is made. The payment is made: either by cheque or by credit card. No mailing of cash will beaccepted.

Article 4: force majeure

The liability of EuropeSoftwares  cannot be implemented if the non-performance, or delay in execution, of the ordered service or of any of the obligations described in thesegeneral sales conditions arises from a case of force majeure. As such, force majeure means any external, unpredictable and irresistible event within the meaning of Section 1148 of the Civil Code. 
Thus,  EuropeSoftwares  is not responsible,especially in case of accident, server error, computer failure, as well as in case of total or partial strikes of any kind hindering the smooth running of the activities of the company  EuropeSoftwares,such asstrikes of transport, communication services,energy suppliers, telecommunications, etc.
The occurrence of a case of force majeure has the effect of suspending the performance by  EuropeSoftwares of the contractual obligations of the order or the present general conditionsofsale.

Article 5: Material competence

Any dispute relating to the interpretation and execution of these terms and conditions of sale is subject to French law.
In the absence of an amicable resolution, the dispute will be brought before theStrasbourg Court of Commerce (FRANCE) - except in the case of a dispute with an individual, in which case the dispute will be brought before the civil court or the commercial court depending on the origin of the dispute.
